Chef wins right to the trade mark ROCKAFELLA.

Terry Miller, a winner of the TV show Hell’s Kitchen, has defeated an opposition by the US record company Universal Music Group, owners of the ROC-A-FELLA label, against his UK trade mark application.

In the ruling the UK IPO hearing officer said that whilst the trade marks ROCKAFELLA and ROC-A- FELLA "...are highly similar, there is a large degree of dissimilarity between restaurant, bar and catering services on the one hand and the services relating to record production etc. on the other". UMG were able to have "bar services" removed from Mr. Miller's application but the opposition was refused in respect of the remaining goods and services in the application. Read more...
