OHIM are planning changes to the Opposition process.

Proposals, published today, will change the way suspensions and extensions of time are dealt with during opposition proceedings.

 

In summary, OHIM are proposing that first and subsequent suspension requests are granted for one year but can be terminated before that one year period expires. First extension requests filed in time will be automatically granted. Subsequent extension requests will only be granted if there is demonstrably a situation of force majeure for the party requesting the second extension. OHIM are awaiting views of the User Group before making a final decision on the proposal. Read more...
